WILSON Cause No.:DDV-18-695D SUMMONS BY PUBLICATION THE STATE OF MONTANA TO ALL PERSONS CLAIMING ANY INTEREST IN OR LIEN UPON THE REAL PROPERTY DESCRIBED IN THIS SUMMONS OR ANY PART OF THE REAL PROPERTY, DEFENDANTS, GREETING: YOU ARE HEREBY SUMMONED and required to appears and answer the Complaint for Quiet Title in this action, filed with the Clerk of this Court, within sixty (60) days after the first publication of this Summons, and set forth what interest or lien, if any, you have in or upon that certain real property or any of the real property situated in the County of Flathead, State of Montana, particularly described as follows: TRACT 1: All of Lot 5 and the North Half of Lot 4 of Block 9 of First Addition to Whitefish Townsite Company's Five-Acre Tracts, according to the map or plat thereof on file and of record in the office of the Clerk & Recorder of Flathead County, Montana. TRACT 2: Lot 6 of Block 9 of First Addition to Whitefish Townsite Company's Five-Acre Tracts, according to the map or plat thereof on file and of record in the office of the Clerk & Recorder of Flathead County, Montana. EXCEPTING THEREFROM the East 14.8 feet of said Lot 6 and The East 14.8 feet of Lot 6 of Block 9 of First Addition to Whitefish Townsite Company's Five-Acre Tracts, according to the map or plat thereof on file and of record in the office of the Clerk & Recorder of Flathead County, Montana. EXCEPTING THEREFROM a triangular tract in said Lot 6 described as follows: Commencing at a point on the North boundary of said Lot 6 a distance of 14.8 feet West from the Northeast corner of Lot 6; thence East along the North boundary of Lot 6 a distance of 4 feet; thence Southwesterly to a point on the South boundary of Lot 6 a distance of 14.8 feet from the Southeast corner of said Lot 6; thence North and parallel with the East boundary of Lot 6 to the Point of Beginning. TRACT 3: A tract of land in Lot 6 of Block 9 of First Addition to Whitefish Townsite Company's Five-Acre tracts, according to the map or plat thereof on file and of record in the office of the Clerk & Recorder of Flathead County, Montana, described as follows: Commencing at a point on the North boundary of said Lot 6 a distance of 14.8 feet West from the Northeast corner of Lot 6; thence East along the North boundary of Lot 6 a distance of 4 feet; thence Southwesterly to a point on the South boundary of Lot 6 a distance of 14.8 feet from the Southeast corner of said Lot 6; thence North and parallel with the East boundary of Lot 6 to the Point of Beginning. TRACT 4: Improvement No. 1905, located on the following described tract of land: Lot 6 of Block 9 of First Addition to Whitefish Townsite Company's Five-Acre Tracts, according to the map or plat thereof on file and of record in the office of the Clerk & Recorder of Flathead County, Montana. EXCEPTING THEREFROM the East 14.8 feet of said Lot 6. YOUR ARE FURTHER NOTIFIED that, unless you appear and answer, Plaintiffs will apply to the Court for the relief demanded in the Complaint, to wit: 1. That title to the Property be established and quieted in the name of Plaintiffs as against Defendants, and all other persons, unknown, claiming or who might claim any right, title, estate or interest upon the Property described in the preceding complaint which is adverse to the Plaintiffs' ownership or a cloud upon Plaintiffs' title thereto, whether such claim or possible claim be present or contingent. 2. That the known and unknown Defendants, and each of them, and their heirs and assigns, be forever barred from having or asserting any right, title, estate, or interest in or to the Property herein described adverse to Plaintiffs.
